Court Approval of $2,900,000.00 Class Action Settlement Benefitting 6,669 Current and Former Employees of Aeropostale

Becerra Law Firm successfully prosecuted a class action in the Los Angeles Superior Court entitled Pakaz et al. v. Aeropostale, Inc., et al., Case No.  BC493736.  It was filed on October 11, 2012 on behalf of 6,669 current and former full-time employees of Aeropostale who worked in Aeropostale’s store locations throughout California.  The lawsuit alleged that Aeropostale systematically implemented an legal “use it or lose it” vacation policy which resulted in the under payment of wages due to its California full-time employees, failed to provide its employees with adequate rest breaks when they worked a shift between 6 and 7 hours long, and failed to timely pay all wages due at the time of termination.

On September 25, 2014, the Court entered an Order granting final approval of a $2,900,000 class action settlement.  More than 6,500 current and former employees who worked for Aeropostale between October 11, 2008 and March 13, 2014, were eligible to receive cash payments under the terms of the settlement.

The settlement provided for each eligible class member to receive compensation that ranged from approximately $46.85 to a maximum payment of approximately $4,410.95.  For currently employed eligible class members, the settlement provided for additional vacation hours to be credited to their accrual bank.  The settlement also provided waiting time penalty payments to those employees no longer employed by the compay.
